1. Acceptance of Terms

By accessing or using FloorQuotePro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

FloorQuotePro is a mobile and web application designed to help flooring contractors create, manage, and send professional quotes to their customers. The Service includes quote creation tools, customer management, PDF generation, and related features.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must be at least 18 years old to use the Service.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payments

4.1 Free and Paid Plans

FloorQuotePro offers both free and paid subscription plans. The free plan includes limited features and quote allowances. Paid plans ("Pro") provide additional features and unlimited quotes as described on our pricing page.

4.2 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis.
  • All fees are non-refundable except as required by law or as explicitly stated in these Terms.
  • You authorize us to charge your payment method on a recurring basis.
  • Prices may change with 30 days notice to existing subscribers.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to Pro features until then. No refunds will be provided for partial billing periods.

4.4 Free Trial

New users may be eligible for a free trial of Pro features. Trial terms will be specified at the time of sign-up. You will be charged automatically at the end of the trial unless you cancel before it ends.

5. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Send spam, unsolicited messages, or fraudulent quotes
  • Upload malicious code or interfere with the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal or unauthorized purpose
  • Impersonate any person or entity
  • Collect or harvest user data without consent
  • Resell or redistribute the Service without permission

6. Your Content

6.1 Ownership

You retain ownership of all content you upload to the Service, including business information, customer data, quotes, and images ("Your Content").

6.2 License to Us

By uploading Your Content, you grant us a limited license to store, process, and display Your Content solely to provide the Service to you. We will not use Your Content for any other purpose without your consent.

6.3 Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of Your Content. You represent that you have all necessary rights to upload and use Your Content.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by FloorQuotePro and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Quote Accuracy and Liability

Important: FloorQuotePro is a tool to help you create quotes. You are solely responsible for:

  • The accuracy of measurements, calculations, and pricing in your quotes
  • Verifying all information before sending quotes to customers
  • Your contractual relationships with your customers
  • Compliance with local licensing, insurance, and business requirements

We provide calculation tools as a convenience, but we do not guarantee their accuracy for your specific situation. Always verify calculations before committing to a price.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOORQUOTEPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless FloorQuotePro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us. Provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

14. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@floorquotepro.com. If a dispute is not resolved within 30 days, either party may proceed with formal legal action.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FloorQuotePro regarding the Service and supersede all prior agreements and understandings.
